QUALIFYING

Williams-Sonoma, Inc. Trade and Contract (formally To The Trade) membership is granted to interior designers, architects, set designers/stagers, home developers and professionals in the hospitality and food & beverage industries.

Please provide two qualifying documents from the list below.

• Business card indicating your design profession
• VAT or Company Registration Number
• Valid membership to a design organization (BIID, IDA, etc.)
• Copy of design certificate or diploma

We reserve the right to make all membership determinations at our sole discretion. Each professional must individually apply for membership by submitting their individual qualifications. Incomplete applications will not be accepted.

Employees of Williams-Sonoma, Inc. and its affiliates, including Williams-Sonoma UK Ltd., are not eligible for membership.

MEMBERSHIP

Membership is not transferable. A membership card can only be used by the named card holder. The named card holder must present his/her valid membership card and valid photo identification in person to receive the trade discount at time of purchase.

Misuse of membership may result in membership termination. Misuse includes, without limitation: use of the trade discount for personal purchases, any resale of merchandise purchased using the trade discount through any retail outlet (e.g., resale on or through any retail or auction Web site or store), reimbursement of trade discount upon merchandise return, transfer of membership, allowing others to use the membership card (e.g., sharing the card with a client), and submitting false, expired or misleading information in connection with a membership application.

This program was formerly known as Williams-Sonoma Inc. Designer Marketplace and To The Trade. Membership cards issued as Designer Marketplace or To The Trade that have not expired are still valid for use until they expire. Upon renewal, member will be issued a Williams-Sonoma, Inc. To the Trade membership card.

Based on cumulative 12-month spend, members receive a tiered discount of 10% to 20% off all regularly priced merchandise at west elm.

With £6,500 in cumulative purchases in a 12-month period.

PLATINUM LEVEL

20% off

With £13,000 in cumulative purchases in a 12-month period.

Gold and Platinum status are granted at the company level, so all members of the same company will have the same membership tier. Purchases (net of returns) made at any of our brands within a 12-month period, whether online, through a retail location or a dedicated Trade Representative, by any registered professional of the same company, will count towards membership upgrades.

Membership status is reviewed at the beginning of each month. If your company qualifies for an upgrade based on previous 12-month purchases, you will automatically receive, via email, a temporary membership card reflecting your new membership status. Your new permanent membership card will arrive in the mail within the following 6-8 weeks. For questions regarding your company’s upgrade status, email a dedicated Trade Representative at tradeeurope@wsgc.com.

Always use your Williams-Sonoma, Inc. Trade and Contract (formally To The Trade) membership card for making trade purchases. Purchases made without your valid membership ID number will not be counted towards membership upgrades. Returned purchases will be deducted from your 12-month cumulative purchase total.

At all brands, the Trade discount is not valid with any other offer, on sale, promotional merchandise, Outlet purchases, floor samples, purchases of gift cards and eGift Cards, promotional items, gift wrap, shipping and processing fees or taxes. The Trade discount is also not valid on purchases of Away, Bali Shades, Leesa, Pelle, Sapira, Smeg, Sonos and products part of the LOCAL collaborations at west elm. The trade discount is not redeemable for cash. Williams-Sonoma, Inc. and west elm reserves the right to change the list of items not eligible for the trade discount at its discretion. Williams-Sonoma, Inc. To The Trade is neither valid nor recognized at Outlet locations. Members may cancel their membership at any time and for any reason by emailing tradeeurope@wsgc.com.

MEMBERSHIP CARD

Williams-Sonoma, Inc. To The Trade membership cards are provided electronically via email when an application has been approved. Members may be subject to additional terms and conditions indicated on membership cards. A membership card is valid until the expiration date noted on card. Williams-Sonoma, Inc. may issue new cards to members who have made purchases in the past two years and have otherwise fully complied with these Terms & Conditions. Williams-Sonoma, Inc. is not responsible for cards lost, damaged or stolen, or for any unauthorized use of cards. Lost, stolen or damaged cards may be canceled and replaced at the sole discretion of Williams-Sonoma, Inc. upon receipt of the required business documentation. The membership card is not a credit card.

TERMINATION

Williams-Sonoma, Inc. reserves the right to terminate a membership or cancel the Trade and Contract program at its sole discretion, with or without notice to the member.

RIGHTS MANAGEMENT TERMS OF USE

Hi — you’re probably here because we requested additional rights in sharing your photo across our channels. USER CONTENT

As between you and us, you own all content and information you post or share using wsib2b.com (the “Site”) or tagging WSI B2B (@WSIB2B), Williams-Sonoma, Inc. or any of its affiliates, such as posting or sharing comments, photos, and videos (referred to as “User Content”).

You give Williams-Sonoma, Inc. permission to use your User Content as follows: you grant to Williams-Sonoma, Inc. and its affiliates a license to reproduce, display, perform, distribute, create derivative works from and otherwise use your User Content in connection with the Site and for other west elm marketing purposes, including without limitation in west elm catalogs, email and other customer communications, store materials and other marketing. NOTICE OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT

We respect the intellectual property rights of others. Please notify us in writing, by email or mail to our designated agent listed below, if you believe that a user of the Site has infringed your intellectual property rights.

To be effective, the notification should include:

• identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
• identification of the claimed infringing material and information reasonably sufficient to permit Williams-Sonoma to locate the material on the Site;
• information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address;

You acknowledge and agree that upon receipt and notice of a claim of infringement, we may immediately remove the identified materials from the Site without liability.

COUNTER-NOTICE BY ACCUSED USER

If we have taken down your materials due to suspicion of copyright infringement, you may dispute the alleged infringement by sending a written communication by email or mail to our designated agent below. That written communication should include the following:

• your physical or electronic signature;
• identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
• a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
• your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which such address is located, or if your address is outside of the United States, the Federal District Court for the Northern District of California, and that you will accept service of process from the person who provided notification of copyright infringement or an agent of such person.
